China Revises Plant Variety Protection Regulations to Strengthen Seed Industry Innovation

On 18 April 2025, the State Council of the People’s Republic of China officially deliberated and approved the Regulations on the Protection of New Plant Varieties (Revised Draft). This landmark regulatory update marks a major stride in protecting intellectual property in China’s seed industry, aiming to stimulate original innovation, reinforce scientific self-reliance, and drive the revitalization of the nation’s agriculture sector.

Key Highlights of the Revised Regulations

The revised regulations are strategically designed to strengthen the legal framework supporting the seed industry’s technological advancements and to create an environment conducive to breeding innovation.

1. Enhanced Publicity and Training

Authorities are tasked with conducting widespread education campaigns to popularize the regulations among enterprises, research institutions, breeding bases, and public exhibitions. Efforts will focus on:

  • Legal interpretation and training sessions
  • Raising public awareness
  • Encouraging the creation, transformation, and application of plant variety rights across scientific research institutions and seed companies

2. Streamlined Regulatory Framework

The government will expedite the revision of supporting rules and procedures to:

  • Simplify application, examination, testing, and authorization processes
  • Set higher technical and operational standards
  • Build a systematic, comprehensive, and efficient protection ecosystem for plant varieties

3. Promotion of the Essential Derived Variety (EDV) System

China will accelerate the implementation of the EDV system, aligning policies with national conditions, agricultural realities, and industry needs. Drawing from international best practices, this move is expected to encourage the protection of innovation while maintaining fair use of genetic resources.

4. Technological Modernization and Database Expansion

The revised framework emphasizes the use of digital platforms by:

  • Implementing online acceptance of applications and examinations
  • Investing in technology R&D
  • Building robust national databases and platforms to enhance protection quality and data transparency

5. Strengthened Enforcement Mechanisms

A zero-tolerance approach will be adopted toward infringement:

  • Enhanced coordination between administrative and judicial protection
  • Rapid response systems for infringement cases
  • Severe penalties for violations, ensuring strong deterrence against illegal activities
